Terms and Conditions of Use

The Aesthetics of Joy and School of Joy Online Programs

1. Notice

These Terms and Conditions are legally binding. Please read them carefully before purchasing, using, or accessing any of our programs, memberships, or services. These Terms apply to all offerings provided by The Aesthetics of Joy and the School of Joy, including Design a Home You Love, The Joy Jumpstart, Wild Joy, The Reclaim Joy Workshop Series, and the School of Joy Commons.


2. Agreement to Terms

All programs, products, and services are owned by Peachy LLC, dba The Aesthetics of Joy (“Company,” “we,” “us,” or “our”), including those offered under the School of Joy. “You” or “your” refers to any user or purchaser of our programs (“Program”).

By purchasing or accessing any Program or membership, you agree to these Terms and Conditions of Use (“Terms”), whether or not you have read them. These Terms govern your access to all materials, communities, communications, and platforms associated with our offerings.

We may update these Terms at any time, with the most recent version reflected by the “Last Updated” date above. If you do not agree with any part of these Terms, contact us at [email protected]. We will make reasonable efforts to revoke your access.


3. Program Use and Consent

You must be at least 18 years old (or of legal age in your jurisdiction) to participate in our Programs. By accessing or using any Program, you confirm that you agree to these Terms, and to any additional policies referenced herein.

Access to programs, including the School of Joy Commons, is personal and non-transferable. Community participation is contingent upon adherence to these Terms and to posted group agreements. Violations may result in immediate removal without refund.


4. License

You are granted a limited, non-transferable, non-sublicensable, non-exclusive, revocable license to use the Program(s) for your personal, individual use. This includes access to membership communities such as the School of Joy Commons. Purchasing a Program or membership does not give you ownership of the content, software, or intellectual property.

You may not share, distribute, reproduce, or repurpose Program materials or community content without express written permission.

We reserve the right to revoke access if you violate these Terms, including misuse of community platforms or directory information. We may seek injunctive relief and/or damages for violations.


5. Fees and Refunds

Fees.
Fees are clearly stated on our website and processed via SamCart (with payments handled through Stripe or PayPal). We reserve the right to change fees at any time.

Subscriptions (School of Joy Commons).
The School of Joy Commons is a monthly subscription billed automatically. You will be charged on a recurring basis unless you cancel before your next billing cycle. No prorated refunds are issued for mid-month cancellations.

Refunds.
We do not offer refunds on digital products or membership subscriptions, including but not limited to The Joy Jumpstart, School of Joy Commons, and online workshops. All sales are final.

Design a Home You Love includes a 14-day refund policy under specific conditions (see below).

Payment Plans & Failures.
If you enroll in a payment plan or membership and your payment fails, you will be removed from the Program or Commons within 3 days unless payment is resolved. You remain responsible for any remaining balance unless otherwise specified.

Chargebacks.
You agree to contact us before initiating a chargeback. If you do initiate a chargeback, you forfeit access to all Programs and related materials, including bonuses, and we reserve the right to provide your financial institution with evidence of your purchase and acceptance of these Terms. Disputes will be governed by New York law.


6. School of Joy Commons

The School of Joy Commons is a private community hosted via WhatsApp and other tools. Participation is limited to paying members. Access is automatically revoked if your subscription lapses or if you violate these Terms.

6.1 Community Behavior

Members must follow group agreements and engage respectfully. Harassment, abuse, sales pitches, or disruption of community culture will result in immediate removal—without refund. This includes removal from all School of Joy programs, present and future.

6.2 WhatsApp Participation

Participation in the Commons is via WhatsApp, a third-party messaging platform. We are not responsible for outages or platform changes. You must abide by WhatsApp’s terms of service in addition to ours.

6.3 Directory and Information Sharing

Members complete a survey via Tally to join the Commons directory. Some responses (e.g., name, location, interests, short bio) are visible to other members.

This directory is provided solely for connection and community purposes. Misuse—including exporting, copying, soliciting, or contacting other members without their consent—is a violation of these Terms and may result in removal and legal action. While we take steps to protect your privacy, we cannot guarantee how other members use shared information.

6.4 No Commercial Use

The Commons may not be used for marketing, sales, lead generation, or recruitment without explicit permission. Violators will be removed immediately and barred from all future School of Joy offerings.

6.5 Content and Conversations

You are welcome to contribute ideas, links, and discussions. However, respectful engagement is expected. We reserve the right to moderate, remove, or block content or users at our discretion to maintain the integrity of the community.

6.6 Assumption of Risk

By participating, you acknowledge that you are engaging in a shared space and that confidentiality cannot be guaranteed. You are responsible for your own disclosures and assume all risks related to participation.


7. Intellectual Property

All content, materials, and branding associated with our Programs—including videos, worksheets, logos, and design—are owned by The Aesthetics of Joy or licensed to us.

You may not reproduce, distribute, or claim ownership of our intellectual property. You may only use our trademarks or materials with prior written consent. Violations may result in legal action and injunctive relief.


8. Use of Our Content

If you wish to reference, publish, or share our content in any form, you must request written permission in advance by contacting [email protected].


9. Legal Enforcement

Unauthorized use, copying, or distribution of our content may result in civil or criminal penalties. By accessing our Programs, you consent to personal jurisdiction in New York for any disputes.


10. Your Submissions

If you post or submit any content (comments, photos, videos, etc.) to our platforms, you grant us a royalty-free, irrevocable license to use, publish, or repurpose it unless you clearly opt out at the time of submission. You waive any expectation of compensation or privacy regarding your submission.


11. Image and Model Release

By submitting or using an image (e.g., your profile photo, a photo you've taken) in connection with a Program, you confirm that you own the rights to it and grant us a license to use it for reasonable business purposes unless you opt out in writing.


12. Use Without Notice

We may use submitted images or content in publications or marketing materials without explicitly notifying you.


13. Security

We use reasonable security practices to protect data. However, no system is completely secure. You accept the risk of unauthorized access and are responsible for protecting your login credentials.

Payments are processed through SamCart using Stripe or PayPal. By using these processors, you accept their terms and any associated risks.


14. Personal Information

We do not share your personal information with third parties except as required by law or to enforce these Terms. Any information you choose to share in our intake forms or surveys—such as your name, location, interests, or short bio—will only be visible to other members of the School of Joy Commons through our private member directory.

We take care to keep this directory private and accessible only to fellow members. However, because we cannot fully control the actions of other individuals, we cannot guarantee that information will never be misused or shared without your consent. By participating, you acknowledge this risk and agree that we are not liable for actions taken by other members. We encourage you to share only what you feel comfortable sharing in a community environment.


15. Confidentiality

We do not guarantee confidentiality unless specifically agreed upon in writing or required by law.


16. Assumption of Risk

You assume full responsibility for any decisions or actions taken as a result of using our Programs. We are not liable for any outcomes related to your use of the materials.


17. Notices

You agree to receive all notices and communications from us electronically, via the email address you provide.


18. General Disclaimer

We are not responsible for any losses, injuries, or damages resulting from your use of our Programs. Our offerings do not constitute medical, legal, psychological, or financial advice and should not replace professional care.


19. Content & Results Disclaimer

Your results may vary. We do not guarantee success or specific outcomes. Any examples are not typical and should not be relied upon for results.


20. Third-Party Disclaimer

We are not responsible for the actions or conduct of any Program participant, including defamatory or offensive behavior.


21. No Warranties

Programs and materials are provided “as is,” without warranties of any kind. We do not guarantee accuracy, reliability, uninterrupted access, or error-free content.


22. Technology Disclaimer

We rely on third-party platforms (e.g., Kajabi, WhatsApp, Tally) to deliver content and do our best to ensure reliable access. However, technical issues may occur, and we are not responsible for failures outside our control.


23. Indemnification

You agree to indemnify and hold harmless The Aesthetics of Joy, its team, affiliates, and partners from any claims, losses, or legal expenses arising from your use of the Program or violation of these Terms, including misuse or unlawful activity.


24. Limitation of Liability

We are not liable for any direct or indirect damages related to your use of our Programs, including loss of income, data, goodwill, or other harm. This includes issues caused by third-party tools or services or actions taken by other Commons members.


25. Dispute Resolution

If you have an issue with our Programs, you agree to contact us first. If we cannot resolve the matter through good-faith negotiation, you agree to attempt mediation before filing a lawsuit. These Terms are governed by the laws of New York.


26. Non-Disparagement

You agree not to knowingly make false or harmful statements about our Company, Programs, or team that could cause material harm to our reputation. If such conduct occurs, we reserve the right to remove your access and pursue appropriate legal remedies.


27. Miscellaneous

All Rights Reserved. Any rights not expressly granted in these Terms are reserved.
Entire Agreement. These Terms constitute the entire agreement between you and the Company.
Severability. If any part of these Terms is deemed unenforceable, the rest remains valid.
Force Majeure. We are not liable for delays or failures caused by events outside our control.
